This article explores innovative legal tools in built environment settings. Using tangible examples, the discussion will leverage the authors' expertise in the law, public health, and architecture to explore strategies in domestic and international settings to explain how healthy spaces make a direct public health impact on people's lives.

A workshop in Philosophy for Children was offered this summer at Viterbo College with generous support from the Wisconsin Humanities Committee. Dr. Ronald Reed and the author conducted the week long workshop. The workshop was promoted primarily by distribution of brochures to regional schools. Four questions were addressed in the brochure: What is Philosophy for Children?, How will Philosophy for Children work in your classroom?, Why teach Philosophy for Children?, and Who should attend?. Hunger striking is a form of nonviolent action of last resort. It is a tactic used by powerless individuals to challenge those in power and achieve change. Many authors have emphasized that hunger strikers are not suicidal, but when oppressed people run out of other ways to protest or demand sociopolitical change, some of them are willing to place their health and life at risk to achieve their goals. Background The involvement of pregnant women in vaccine clinical trials presents unique challenges for the informed consent process. We explored the expectations and experiences of the pregnant women, spouses/partners, health workers and stakeholders of the consent process during a Group B Streptococcus maternal vaccine trial. Methods We interviewed 56 participants including pregnant women taking part in the trial, women not in the trial, health workers handling the trial procedures, spouses, and community stakeholders. We conducted 13 in-depth interviews and focus group (...) discussions with 23 women in the trial, in-depth interviews with 5 spouses, and 5 women not in the trial, key informant interviews with 5 health workers and 5 other stakeholders were undertaken. Results Decision-making by a pregnant woman to join a trial was done in consultation with spouse, parents, siblings, or trusted health workers. Written study information was appreciated by all but they suggested the use of audio and visual presentation to enhance understanding. Women stressed the need to ensure that their male partners received study information before their pregnant partners joined a clinical trial. Confidentiality in research was emphasised differently by individual participants; while some emphasised it for self, others were keen to protect their family members from being exposed, for allowing them to be involved in research. However, others wanted their community participation to be acknowledged. Conclusion We found that pregnant women make decisions to join a clinical trial after consulting with close family. Our findings suggest the need for an information strategy which informs not only the pregnant woman, but also her family about the research she is invited to engage in. (shrink)

Genetic information and technologies are increasingly important in health care, not only in technologically advanced countries, but world-wide. Several global factors promise to increase future demand for morally conscious genetic health services and research. Although they are the largest professional group delivering health care world-wide, nurses have not taken the lead in meeting this challenge. Insights from feminist analysis help to illuminate some of the social institutions and cultural obstacles that have impeded the integration of genetics technology into the discipline (...) of nursing. An alternative model is suggested - the transdisciplinary model - which was developed initially by a nurse and introduced in the 1970s into the delivery of health care and social services for children with developmental disabilities. This holistic model enables all health care professionals to have an equal voice in determining how genetic health care will be globalized. (shrink)

Experiential evidence shows that pain is associated with common meanings. These include a meaning of threat or danger, which is experienced as immediately distressing or unpleasant; cognitive meanings, which are focused on the long-term consequences of having chronic pain; and existential meanings such as hopelessness, which are more about the person with chronic pain than the pain itself. This interdisciplinary book - the second in the three-volume Meanings of Pain series edited by Dr Simon van Rysewyk - aims to better (...) understand pain by describing experiences of pain and the meanings these experiences hold for the people living through them. The lived experiences of pain described here involve various types of chronic pain, including spinal pain, labour pain, rheumatic pain, diabetic peripheral neuropathic pain, fibromyalgia, complex regional pain syndrome, endometriosis-associated pain, and cancer-related pain. Two chapters provide narrative descriptions of pain, recounted and interpreted by people with pain. Language is important to understanding the meaning of pain since it is the primary tool human beings use to manipulate meaning. As discussed in the book, linguistic meaning may hold clues to understanding some pain-related experiences, including the stigmatisation of people with pain, the dynamics of patient-clinician communication, and other issues, such as relationships between pain, public policy and the law, and attempts to develop a taxonomy of pain that is meaningful for patients. BackgroundCarefully planned research is critical to developing policies and interventions that counter physical, psychological and social challenges faced by young people living with HIV/aids, without increasing burdens. Such studies, however, must navigate a ‘vulnerability paradox’, since including potentially vulnerable groups also risks unintentionally worsening their situation. Through embedded social science research, linked to a cohort study involving Adolescents Living with HIV/aids (ALH) in Kenya, we develop an account of researchers’ responsibilities towards young people, incorporating concepts of vulnerability, resilience, and agency (...) as ‘interacting layers’.MethodsUsing a qualitative, iterative approach across three linked data collection phases including interviews, group discussions, observations and a participatory workshop, we explored stakeholders’ perspectives on vulnerability and resilience of young people living with HIV/aids, in relation to home and community, school, health care and health research participation. A total of 62 policy, provider, research, and community-based stakeholders were involved, including 27 ALH participating in a longitudinal cohort study. Data analysis drew on a Framework Analysis approach; ethical analysis adapts Luna’s layered account of vulnerability.ResultsALH experienced forms of vulnerability and resilience in their daily lives in which socioeconomic context, institutional policies, organisational systems and interpersonal relations were key, interrelated influences. Anticipated and experienced forms of stigma and discrimination in schools, health clinics and communities were linked to actions undermining ART adherence, worsening physical and mental health, and poor educational outcomes, indicating cascading forms of vulnerability, resulting in worsened vulnerabilities. Positive inputs within and across sectors could build resilience, improve outcomes, and support positive research experiences.ConclusionsThe most serious forms of vulnerability faced by ALH in the cohort study were related to structural, inter-sectoral influences, unrelated to study participation and underscored by constraints to their agency. Vulnerabilities, including cascading forms, were potentially responsive to policy-based and interpersonal actions. Stakeholder engagement supported cohort design and implementation, building privacy, stakeholder understanding, interpersonal relations and ancillary care policies. Structural forms of vulnerability underscore researchers’ responsibilities to work within multi-sectoral partnerships to plan and implement studies involving ALH, share findings in a timely way and contribute to policies addressing known causes of vulnerabilities. BackgroundWith the emergence of Brain Computer Interfaces, clinicians have been facing a new group of patients with severe acquired brain injury who are unable to show any behavioral sign of consciousness but respond to active neuroimaging or electrophysiological paradigms. However, even though well documented, there is still no consensus regarding the nomenclature for this clinical entity.ObjectivesThis systematic review aims to 1) identify the terms used to indicate the presence of this entity through the years, and 2) promote an informed discussion (...) regarding the rationale for these names and the best candidates to name this fascinating disorder.MethodsThe Disorders of Consciousness Special Interest Group of the International Brain Injury Association launched a search on Pubmed and Google scholar following PRISMA guidelines to collect peer-reviewed articles and reviews on human adults published in English between 2006 and 2021.ResultsThe search launched in January 2021 identified 4,089 potentially relevant titles. After screening, 1,126 abstracts were found relevant. Finally, 161 manuscripts were included in our analyses. Only 58% of the manuscripts used a specific name to discuss this clinical entity, among which 32% used several names interchangeably throughout the text. We found 25 different names given to this entity. The five following names were the ones the most frequently used: covert awareness, cognitive motor dissociation, functional locked-in, non-behavioral MCS and higher-order cortex motor dissociation.ConclusionSince 2006, there has been no agreement regarding the taxonomy to use for unresponsive patients who are able to respond to active neuroimaging or electrophysiological paradigms. Developing a standard taxonomy is an important goal for future research studies and clinical translation. We recommend a Delphi study in order to build such a consensus. (shrink)

Those articles, eventually published as the book Buddhists Talk About Jesus,Christians Talk About the Buddha (Continuum, 2000), asked Christians and Buddhists to critique the founder of the other religion. The format proved successful and provoked some good (...) methodological discussion (see Ingram, p. 75 ff).Thus, in this issue we continue the format with a new question: how have you used and/or learned from the meditative and prayer practices of the other tradition? The assignment drew enthusiastic response, especially from Christians who were asked to write about their experiences of Buddhist meditation. We are publishing five articles by Frances Adeney, Mary Frolich, Paul Ingram, Terry Muck, and Bardwell Smith, along with responses by two Buddhists--Grace Burford and Robert Thurman.In our next issue (volume 22), we will publish articles by five Buddhist authors and two Christian respondents. We will be interested to see if these articles give us clues as to why Christians were more eager to take on this assignment than were Buddhists.In compiling this collection of articles, we made three observations related to good interreligious interchanges. The first is that this form of dialogue requires a good deal of trust among the participants. Talking candidly about important features of the other person's religion runs the risk of offense.Yet the way the writers and respondents--mostly longtime members of the Society for Buddhist-Christian Studies--wrote indicates that trust is developing.Of course, trust is essential for any kind of healthy dialogue. The reason for the development of interreligious dialogue in this century has been as a response to the level of destructive criticism so common to interchanges among adherents of the world's religions. To address this unacceptable level of conflict, it was necessary to step back and consciously adapt a stance of silent humility about and toward the religious other. As the dialogue movement developed, conversations began to punctuate the silence, conversations that hopefully demonstrated openness, understanding our mutual pasts and intertwined futures. Years of this kind of openness leading to understanding makes it possible to enter into a new era of dialogue, the era of constructive criticism made up of equal parts of honest commentary and unequivocal support.We have moved through this idealized paradigm of responses very imperfectly, of course. The level of destructive conflict is still unacceptably high, silent humility is [End Page iii] in sometimes short supply, openness drowned out by self-interest, and constructive criticism imperfectly practiced. Yet we must move forward, experiencing flashes of epiphany and enlightenment as humility, openness, and mutuality ride the wings of developing trust.The second observation--more a realization, actually--is that this form of interreligious interchange requires a high level of sophistication about religions other than one's own. It is hard to pin down the exact nature of this sophistication. It is not just knowledge about the other's religion that is required, although it is partly that. One cannot comment effectively about Buddhist meditation unless one has a certain fundamental understanding of what Buddhist meditation is. Christian prayer is not easy to define, but certain features of the practice are universally recognized among both theologians and practitioners. To conduct the kind of mutual evaluation asked for in this type of dialogue, basic levels of understanding are necessary.The dialogue as we envision it, however, goes beyond knowledge. In our letter of invitation to participants, we made it clear that we were also interested in writers who had some experience with the other religion's spiritual practice. As we received and evaluated submissions, it became clear that what gave the essays power and authority was the mixture of knowledge and experience of the others' spiritual practice. As you will see, it wasn't always the case that our writers had adapted meditative or prayer practice wholesale. But invariably their experience gained through learning about the practice led to changes: deeper, richer practice in their own tradition.This... (shrink)

This is a matter of considerable importance to me, but you might imagine that it is difficult to read an analysis of events in which I was so involved that takes so little account of my/our point of view. Let (...) me add, after reading your response, that I do recognize that this is through no fault of your own, and as you indicated to me later, you assiduously strove to get more information. I believe it was Alfred Kazin who (I've heard) said that the movements of today make the dissertations of tomorrow. Since that is always a difficulty, I am sure that my experience is not singular. Unfortunately, in my view, the decontextualization of Audre Lorde's speech at that conference can serve to perpetuate the misunderstanding that underlay the destructive polarization that occurred at that time. To accept her view that the event was organized with no effort to include women of color by oblivious, racist white women is surely not what happened. In fact, the estrangement between white and black women at the time of the "Second Sex Conference" had much deeper causes (the enduring structures of racism in our country) for which I believe no individual could be held responsible.First, let me clarify an important fact. While we organizers of the conference invited numerous black and third world women to participate, we were consistently declined. For instance, Mary Helen Washington said she did not want to speak to an audience of only white women, and it was her experience that only white women came to feminist conferences. Indeed, at the time Michele Wallace, who probably would have been interested had she been available, was vociferously complaining about the lack of interest, indeed the rejection of feminism, among black women. Audre Lorde herself, one of our consultants, had been apprised of the participants for months and never named anyone who could participate. Similarly, Robin [End Page 286] Morgan had been consulted and had offered no suggestions of black participants. Yet ten days before the conference her young black protégé at Ms., Susan McHenry, appeared with a series of demands, including a list of black women she wished to see invited to the conference. Although I had met with Robin Morgan months before, she had never told me of Susan McHenry or proposed her as a participant, rather her interest had been focused on what would become the anti-pornography movement, similar to the interests of Kathy Barry who wrote about female sexual slaves. At the conference, Susan McHenry did speak; she expressed her indignation and outrage, and suggested that the entire conference was a racist gathering that should change direction and consider only the issue of racial exclusion.It is certainly true that the organizers were distressed by the same issue prior to the conference. After nearly a year of organizing, soliciting, and publishing open calls for participation, we were absolutely desperate to find participants who would reflect racial and ethnic groups other than white middle class. But in 1979 the institution of women's studies looked very different than it does now--feminism was a political movement not an academic institution, and only a few women in any university had become interested in it. And that does not even begin to address how few women, let alone black women, were in the universities in 1979!A second important point is that Audre Lorde was not speaking to an audience who disagreed with her; she was speaking to an audience who were already inflamed because they felt that certain identities had been left out of the conference. Introduction:To meet and take care of people with dementia implicate professional and moral challenges for caregivers. Using force happens daily. However, staff also encounter challenges with the management in the units. Managing the caretaking function is also significant in how caretakers experience working in dementia care.Purpose:The purpose of this study is to explore the caregiver’s experiences with ethical challenges in dementia care settings and the significance of professional leadership in this context.Method:The design is qualitative, and data appear through narrative interviews. (...) A total of 23 caretakers participated in the study. The transcribed interviews were subjected to a phenomenological-hermeneutical interpretation.Ethical considerations:The respondents signed an informed consent for participation prior to the interviews. They were assured anonymity and confidentiality in the publication of the data. Ricoeur’s method for interpretation ensures anonymity as the researcher relates to the data as one collective text. The study is part of a larger research project in ethics, in its entirety approved in line with the Helsinki Convention.Results:The findings show that the caretakers experienced inadequacy. Some of them described a negative work atmosphere where they experienced that their leaders did not take them seriously. Because of this, informal negative sub-groups functioned as an exclusive debriefing arena. Some of the informants described the opposite experience where the leaders actively supported them.Discussion:The analyses of the findings are discussed in light of the concepts of trust and mistrust in leadership.Conclusion:There is a correlation between the leadership and the caregivers’ experience of being in difficult situations. It is learning how to stand alone, unpopular and sometimes reviled, and how to make common cause with those others identified as outside the structures in order to define and seek a world in which we can all flourish.--Audre Lorde, Sister Outsider 112Fifty years ago, in 1949, Simone de Beauvoir's book entitled The Second Sex was published in France. She did not consider herself a philosopher because, to her, a philosopher was "someone who has built a great system" (Simons and Benjamin 1979, 338). Her book, nonetheless, became a milestone in feminist philosophy, for it synthesizes elements of existentialism, phenomenology, and socialism in an account of women's situation in society. Central to this account is Beauvoir's concentration upon representations of "self" and "other." For example, Beauvoir affirmed, "The category of the Other is as primordial as consciousness itself. In most primitive societies, in the most ancient mythologies, one finds the expression of a duality--that of the Self and the Other. This duality was not originally attached to the division of the sexes; it was not dependent upon any empirical facts" (1993, xl). In an interview, Beauvoir stressed, "I believe that the Other is not simply an idealist relationship, it is a materialist relationship" (Simons and Benjamin 1979, 345). To develop her analysis, Beauvoir drew upon another binary, "master" and "slave." Like most of the conference participants, Lorde was a woman, a feminist, a socialist, a public intellectual, and an activist scholar. Both women rejected biology as the basis for women's situation, believing instead that material conditions are most fundamental. Both commented upon the power of symbolism, especially myths about others, in perpetuating social inequalities and failing to differentiate categories for others. Both saw the relationship between "self" and "other" as a vital and creative tension.To understand this tension, Beauvoir drew explicitly on Hegel's ideas as they were treated in Sartre's oeuvre (Lloyd 1983). In contrast, Lorde may have drawn upon conceptions of double consciousness among black public intellectuals in the United States (Henderson 1989, 17-21). Unlike Beauvoir, Lorde was a lesbian, a mother, and a black woman for whom Beauvoir's analogies between the status of women and the status of "Negroes" were problematic. HuntIThe position I will be taking here will seem very peculiar to many people. I will be treating a novel as a discussion of the work of a philosopher—namely, Friedrich Nietzsche. Worse yet, I will be treating it as a discussion that is philosophically penetrating and deserves to be taken seriously. Still worse, the novel is Ayn Rand's early novel (...) The Fountainhead. I think it is safe to say that her reputation, among academics who discuss the works of philosophers, is very low. If the reader will only bear with me, though, I think I can make a case that Rand opens a line of inquiry about Nietzsche's ideas and values that is not only quite interesting in itself but one that ought to be pursued further by others.There has always been ample reason to associate Nietzsche with The Fountainhead.1 He is after all, the only philosopher who is more or less directly quoted in the book.2 Beyond that, Rand's novel has many other passages that students of Nietzsche instantly recognize as conscious references to him or deliberate echoes of his style. In addition, she revealed, in an introduction written for the twenty-fifth anniversary edition, that the following quotation from Beyond Good and Evil had originally stood at the head of the book when it was still in manuscript:It is not the works, but the belief which is here decisive and determines the order of rank to—employ once more an old religious formula with a new and deeper meaning—it is some fundamental certainty which a noble soul has about itself, something which is not to be sought, is not [End Page 79] to be found, and perhaps, also, is not to be lost—The noble soul has reverence for itself.—3She said, in the same introduction, that she removed the quotation (evidently, immediately before publication) for philosophical reasons, because of her "profound disagreement with the philosophy of its author." Nietzsche, she says, was fundamentally "a mystic and irrationalist," and even in this quotation, chosen for its content, insinuates a philosophical position that she regards as erroneous (namely, determinism). Even her statement of what she likes about this passage is rather constrained: "as a poet [ie., not as a philosopher], he projects at times (not consistently) a magnificent feeling for man's greatness, expressed in emotional, not intellectual terms."4It is of course true enough that Rand does disagree with Nietzsche, and for more or less the reasons that she suggests here, but it is also true that the passage she has quoted expresses some ethical themes—nobility, order of rank, the "pathos of distance," and (most obviously) the idea of self-reverence as a characteristic of the ethically good—which are at least as important in The Fountainhead as they are in Nietzsche's writings. Understanding how people comprehend visual narratives (including picture stories, comics, and film) requires the combination of traditionally separate theories that span the initial sensory and perceptual processing of complex visual scenes, the perception of events over time, and comprehension of narratives. Existing piecemeal approaches fail to capture the interplay between these levels of processing. Here, we propose the Scene Perception & Event Comprehension Theory (SPECT), as applied to visual narratives, which distinguishes between front-end and back-end cognitive processes. Front-end processes occur (...) during single eye fixations and are comprised of attentional selection and information extraction. Back-end processes occur across multiple fixations and support the construction of event models, which reflect understanding of what is happening now in a narrative (stored in working memory) and over the course of the entire narrative (stored in long-term episodic memory). We describe relationships between front- and back-end processes, and medium-specific differences that likely produce variation in front-end and back-end processes across media (e.g., picture stories vs. film). We describe several novel research questions derived from SPECT that we have explored. By addressing these questions, we provide greater insight into how attention, information extraction, and event model processes are dynamically coordinated to perceive and understand complex naturalistic visual events in narratives and the real world.
